HOW LONG DOES A BANKRUPTCY TAKE?

A Chapter 7 bankruptcy case can take between 5-8 months to complete. A Chapter 13 bankruptcy case can take an average of 3-5 years to complete.

I HAVE FILED FOR BANKRUPTCY BEFORE, WHEN CAN I FILE AGAIN?

A Chapter 7 Bankruptcy case may be filed once every 8 years. A Chapter 13 Bankruptcy can be filed shortly after a Chapter 7, but if you want to receive a discharge of debts in the Chapter 13 you must wait at least 4 years between a Chapter 7 and a Chapter 13.

DOES DEBT GO AWAY AFTER A CERTAIN PERIOD OF TIME?

Judgments entered against you are subject to collection of the debt for up to 20 years. Credit card companies have five years to sue for non-payment of credit card debt. You cannot be threatened with collection of a debt beyond these time periods. The time is calculated based upon your last payment. For example, if you go 3 years without making a payment then make even a small payment, you will refresh the time period to the date of your last payment.
